CONTRACTUAL CONDITIONS AND OTHER IMPORTANT NOTICES
PASSENGERS OF A FLIGHT WITH A FINAL DESTINATION OR A STOP IN A COUNTRY OTHER THAN THE COUNTRY OF DEPARTURE ARE INFORMED THAT INTERNATIONAL TREATIES KNOWN AS THE MONTREAL CONVENTION, OR ITS PREDECESSORS, THE WARSAW CONVENTION, INCLUDING THEIR AMENDMENTS (THE WARSAW CONVENTION SYSTEM), MAY APPLY TO THE ENTIRE FLIGHT, INCLUDING A PORTION THEREOF FROM A CERTAIN COUNTRY. FOR THESE PASSENGERS, THE APPLICABLE TREATY, INCLUDING THE SPECIAL TRANSPORT CONTRACTS INCLUDED IN ANY APPLICABLE FARE, GOVERNS AND MAY LIMIT THE LIABILITY OF THE CARRIER.

NOTICE OF LIABILITY LIMITATION

The Montreal Convention or the Warsaw Convention system may apply to your flight, and these Conventions govern and may limit the liability of air carriers for bodily injury or death, for loss or damage to baggage, and for delay. Where the Montreal Convention applies, liability is limited as follows:

  1. There are no financial limits with regard to bodily injuries or death.
  2. With regard to destruction, loss, damage, or delay of baggage, the liability is limited to 1,131 Special Drawing Rights (approximately 1,200 Euros; 1,800 USD) per passenger, in most cases.
  3. For damages caused by the delay of your flight, the liability is limited to 4,694 Special Drawing Rights (approximately 5,000 Euros; 7,500 USD) per passenger in most situations.

Regulation (EC) No 889/2002 requires carriers from the European Community to apply the provisions of the Montreal Convention and the related limitations of liability of carriers for all passenger and baggage transport activities by air. Many carriers that are not part of the European Community have chosen to apply the same convention with regard to the transportation of passengers and their baggage.
Where the Warsaw Convention system applies, the following liability limits may apply:

  1. 16,600 Special Drawing Rights (approximately 20,000 Euros; 20,000 USD) for bodily injury or death if the Hague Protocol applies, or 8,300 Special Drawing Rights (approximately 10,000 Euros; 10,000 USD) if only the Warsaw Convention applies. Many carriers have voluntarily waived these limits entirely, and US regulations provide that, for flights to, from, or with a stopover in the United States, the limit must not be less than 75,000 USD.
  2. 17 Special Drawing Rights (approximately 20 Euros; 20 USD) per kg for loss, damage, or delay of checked baggage, and 332 Special Drawing Rights (approximately 400 Euros; 400 USD) for carry-on baggage.
  3. The carrier may be liable for damages caused by delay.

You can obtain more information from the carrier regarding the applicable limits of liability for your flight. If your flight involves multiple carriers, you should contact each carrier individually for information on the applicable liability limits. Regardless of the applicable Convention for your flight, you may benefit from a higher limit of liability in case of loss, damage, or delay of baggage by declaring a special value of the baggage at check-in and by paying all applicable additional charges. Otherwise, if the value of your baggage exceeds the applicable liability limit, you should fully insure your baggage before traveling. Time limit for legal action: Any action for claiming damages must be initiated within two years from the date the aircraft arrives or the date on which the aircraft should have arrived. Claims regarding baggage: a written notice must be sent to the carrier within 7 days of receiving the checked baggage in case of damage, and within 21 days of the date on which it was made available to the passenger in case of delay.
Notice of Contractual Conditions Included by Reference

  1. Your air transport contract with the carrier providing your air transport, whether international, domestic, or a portion of an international journey, is subject to this notice; any notices or receipts from the carrier; and the individual terms and conditions of the carrier (Conditions), regulations, rules, and policies (Regulations), and all applicable fares.
  2. If your transport is performed by multiple carriers, different Conditions, Regulations, and all applicable fares may apply for each carrier.
  3. The Conditions, Regulations, and all applicable fares of each carrier are, according to this notice, incorporated by reference and form part of your air transport contract.
  4. Any discrepancy between this notice and the actual contract of carriage or any other document will be resolved in favor of the actual contract or document.

Your air transport contract with the carrier providing your air transport, whether international, domestic, or a portion of an international journey, is subject to this notice; any notices or receipts from the carrier; and the individual terms and conditions of the carrier (Conditions), regulations, rules, and policies (Regulations), and all applicable fares.

  1. If your transport is performed by multiple carriers, different Conditions, Regulations, and all applicable fares may apply for each carrier.
  2. The Conditions, Regulations, and all applicable fares of each carrier are, according to this notice, incorporated by reference and form part of your air transport contract.
  3. The Conditions may include, but are not limited to:
  • Carrier's liability conditions and limits for passenger bodily injury or death.
  • Carrier's liability conditions and limits for loss, damage, or delay of goods and baggage, including fragile or perishable items.
  • Special rules for declaring a higher value of baggage and paying additional fees.
  • Application of the Carrier's Conditions and liability limits with respect to actions taken by the carrier's agents, officials, and representatives, including anyone providing equipment or services to the carrier.
  • Restrictions on claims, including time limits for passengers to file claims or initiate proceedings against the carrier.
  • Rules regarding reconfirmations or reservations; check-in times; use, duration, and validity of air transport services; and the carrier's right to refuse carriage.
  • Carrier's rights and liability limits for delay or non-performance of a service, including schedule changes, alternative carriers or aircraft, and rerouting, and, if required by applicable law, the carrier's obligation to notify passengers of the identity of a substituted carrier or aircraft.
  • Carrier's right to refuse carriage to passengers who do not comply with applicable laws or fail to present all necessary travel documents.

     4. You can obtain more information about your transport contract and how to obtain a copy of it at ticket sales points. Many carriers have included this information on their websites as well. If applicable law provides, you have the right to inspect the complete text of your transport contract at the airport and at the carrier's sales points, and upon request, you have the right to receive a free copy by mail or other courier service from each carrier.
     5. If a carrier sells air transport services or accepts baggage for transport on another carrier, it does so solely as an agent for the other carrier.

SOME COUNTRIES MAY REQUIRE YOUR CARRIER TO PROVIDE INFORMATION ABOUT OR ALLOW ACCESS TO PASSENGER DATA.
REFUSAL TO TRANSPORT:Flights may be overbooked, and there is a very small probability that a seat may not be available on the flight even if you have a confirmed reservation. In most situations, if you are involuntarily denied boarding, you are entitled to compensation. If required by applicable law, the carrier must seek your consent before involuntarily denying boarding to a person. Contact the carrier for the complete rules regarding compensation for denied boarding (DBC) and information about the carrier's boarding priorities.

BAGGAGE:For certain types of items, a higher value may be declared. Carriers may apply special rules for fragile, valuable, or perishable items. Check with your carrier. Checked Baggage:Carriers may provide a free allowance for checked baggage, which is determined by the carrier and may depend on class and/or route. Carriers may apply additional charges for checked baggage exceeding their provided allowance. Consult your carrier. Carry-On Baggage:Carriers may provide a free allowance for carry-on baggage, which is determined by the carrier and may depend on class, route, and/or aircraft type. It is recommended to minimize carry-on baggage. Consult your carrier. If multiple carriers provide your journey, each carrier may have different rules for baggage (both checked and carry-on). SPECIAL LIABILITY LIMITATIONS FOR BAGGAGE FOR TRAVEL TO THE UNITED STATES:For entirely domestic flights between locations within the United States, federal law mandates that any carrier's liability limit for baggage shall be at least USD 3300.00 per passenger, or the amount under current mandate 14 CFR 254.5.

CHECK-IN TIMES:The time indicated on the ticket/receipt is the aircraft's departure time. The flight's departure time is not the same as the time you must check-in or the time you must be present for boarding. Your carrier may refuse transportation if you are late. Check-in times, as announced by the carrier, are the latest times at which passengers can be accepted for the flight; boarding times, as announced by your carrier, are the latest times at which passengers must be present for boarding.

DANGEROUS GOODS (HAZARDOUS MATERIALS). For safety reasons, dangerous goods must not be packed in checked or carry-on baggage unless specifically allowed. Dangerous goods include, but are not limited to: compressed gases, corrosive substances, explosives, flammable liquids and solids, radioactive materials, oxidizing materials, poisons, infectious substances, and bags with installed alarm systems. For safety reasons, additional restrictions may apply. Check with your carrier.
